BMA All Access – Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the BMA All Access Membership (“Membership”) offered by Brand Master Academy (“we,” “our,” “us”). By purchasing, accessing, or participating in the Membership, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use or purchase the Membership.

1. Membership Structure and Access

We offer multiple tiers of membership. Each tier provides a different level of access to educational content, coaching, live events, certification, templates, tools, and community features.

The current tier options and inclusions are listed on our website. Tier inclusions may evolve over time. Access is granted only for the duration of your active subscription.

1.2 Eligibility

Membership is available to individuals aged 18 and over. Access is granted per user. Team or agency access requires a separate group license agreement.

We reserve the right to reject or revoke access at our discretion if eligibility conditions are violated.

2. Account Management and Tier Access

2.1 Account Setup

You must provide accurate and complete information during account creation. You are solely responsible for maintaining the confidentiality of your login credentials.

Sharing login access with others is strictly prohibited and may result in suspension or termination without refund.

2.2 Tier Switching

You may upgrade or downgrade your tier at any time through your account dashboard. Feature access will change based on your selected tier and take effect on your next billing cycle. Downgrading may result in loss of access to certain resources, events, or certifications.

2.3 Termination by Member

You may cancel your subscription at any time. Your access will remain active until the end of the current billing period. No refunds are issued for unused time.

3. Payments and Billing

3.1 Subscription Charges

All Memberships are billed in advance, either monthly or annually, depending on your selection at checkout. Pricing is displayed in your local currency where supported or in USD.

3.2 Automatic Renewal

Subscriptions automatically renew unless cancelled before the end of your current billing period. You authorise us to charge your payment method for each renewal until you cancel.

3.3 Failed Payments and Billing Issues

If a payment attempt fails, you will be notified and reattempts may be made. After multiple failed attempts, access will be suspended. You are responsible for ensuring your billing details are current.

3.4 Refund Policy

All payments are final. We do not offer partial refunds, retroactive discounts, or credits for unused access, missed sessions, or duplicate course ownership.

The Membership is non-refundable and non-transferable. Please consider your needs carefully before purchase.

4. License and Intellectual Property

4.1 Individual Use License

All content provided within the Membership—programs, templates, videos, documents, downloads, live sessions, and tools—is licensed to the purchasing user for personal, non-commercial use only.

You may not:

  • Share, resell, rent, sublicense, or redistribute any content
  • Modify or publish derivative works without express written permission
  • Use BMA content or materials in any training, teaching, or client delivery services

4.2 Intellectual Property Rights

All content remains the exclusive intellectual property of Brand Master Academy and its licensors. Unauthorized use may result in civil and/or criminal penalties.

We reserve the right to revoke access and take legal action for any breach of intellectual property terms.

5. Community Use and Member Conduct

5.1 Community Access

Access to the BMA Circle community is included in select tiers. Access is conditional on adherence to our Community Guidelines.

5.2 Behaviour Standards

By participating in the community, you agree to:

  • Engage respectfully and constructively
  • Refrain from sales pitches or unsolicited contact
  • Avoid harassing, abusive, or discriminatory language
  • Not misuse community platforms for data mining or lead generation

We reserve the right to moderate posts, issue warnings, and remove individuals who violate community standards.

6. Live Sessions, Coaching, and Events

6.1 Tier Eligibility

Only members on qualifying tiers may attend live coaching, expert masterclasses, or Accelerator programs. These features are not available across all tiers.

6.2 Scheduling and Availability

We reserve the right to modify event times, cancel sessions, or substitute speakers. We do not guarantee availability of recordings for all sessions.

6.3 No Guarantees

Coaching and live interactions are designed for educational purposes. We do not guarantee business results, outcomes, or personal gains from participation.

7. Certifications

7.1 Completion and Eligibility

Certifications are offered upon successful completion of relevant coursework and assessments. Only active members are eligible.

7.2 Certification Use

You may display earned certifications publicly. Misrepresentation or misuse of certification credentials will result in revocation and possible removal from the platform.

8. Content Updates and Platform Changes

We continuously improve our content and may update, replace, or retire programs, tools, templates, and platform features at our discretion.

This may include:

  • Adding new curriculum material
  • Sunsetting older modules or content
  • Changing tier access rules

We aim to provide notice of significant changes but are not obligated to preserve access to all historical content indefinitely.

9. Privacy and Data

9.1 Data Collection

We collect and process personal information in accordance with our [Privacy Policy]. This includes usage data, event attendance, progress tracking, and support inquiries.

9.2 Third-Party Services

Your membership may involve integration with external platforms (e.g. Thinkific, Circle, Zoom). Your use of those services is subject to their terms and privacy policies.

10. Termination and Breach

10.1 Breach by Member

We reserve the right to suspend or terminate your access without refund if you:

  • Violate these Terms
  • Misuse content or breach IP terms
  • Engage in abusive or harmful conduct
  • Misrepresent your credentials or misuse certifications

10.2 Termination by Us

We may discontinue the Membership or a tier at any time. If this occurs during your billing cycle, you will receive a pro-rata refund.

11. Disclaimers and Limitation of Liability

11.1 No Business Advice

All content is for educational purposes only. No content or advice should be interpreted as financial, legal, or professional business advice.

11.2 No Guarantee of Results

We do not guarantee personal or business outcomes. Results will vary based on your background, effort, and external market conditions.

11.3 Limitation of Liability

To the fullest extent permitted by law, Brand Master Academy is not liable for any indirect, incidental, or consequential damages, including data loss, business interruption, or loss of income.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the membership platform. Continued use after updates constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of France. Any disputes will be subject to the exclusive jurisdiction of the courts of Bayonne, France.
